‘The Right to Information Act 2005’ as passed by both the House of Parliament, received the Presidential assent on 15 June 2005 in pursuance of which “The Right to Information Act 2005” was published in the Gazette of India on 21st June 2005. NAFSCOB is covered under the provisions of the said Act and is under obligation to maintain the publish records / data as indicated in Section 4(1)(a) and 4(1)(b) of the Right to Information Act, 2005. In view of the same NAFSCOB has formulated ‘Right to Information Rules, 2005 – NAFSCOB’ which have been adopted in the Meeting of the Board of Directors held on 21-12-2005 at Jaipur:

RIGHT TO INFORMATION RULES, 2005 – NAFSCOB
(As adopted in the Meeting of the Board of Directors of NAFSCOB held at Jaipur on 21-12-2005)
1. Short title and commencement
- These rules may be called the ‘NAFSCOB Right to Information Rules, 2005’.
- They shall come into force with effect from the date on which the members of the Board of Directors approve the same.
2. Definitions
In these rules, unless there is anything repugnant in the subject or context
- Act’ means the Right to Information Act, 2005 (No.22 of 2005);
- ‘Rules’ means Principal Rules with regard to Right to Information Act, 2005 as published in the Gazette of India vide Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training) Notification No.34012/8(s)/2005 – Estt. (B) dated 16 September 2005 {G.S.R. No.336 dated 1st October 2005, Part – II, Section 3, Sub-Section (i)};
- ‘NAFSCOB’ means the National Federation of State Co-operative Banks, Navi Mumbai – 400 703;
- ‘Right to Information Rules, 2005 – NAFSCOB’ means the Sub-Rules framed by NAFSCOB as per the provisions contained in the ‘Right to Information Act, 2005’ (No.22 of 2005) and (b) above;
- ‘Central Public Information Officer’ (CPIO) means an officer designated as ‘Central Public Information Officer’ in the NAFSCOB, by the Board of Directors of NAFSCOB, as per Section 5(1) of the Act;
- ‘Appellate Officer’ (AO) means an officer of NAFSCOB, by the Board of Directors of NAFSCOB, who is designated as Appellate Officer and who is senior in rank to the CPIO; as per Section 19(1) of the Act;
- ‘Central Information Commission’ means the authority appointed under Section 12(1) of the Act;
- ‘BPL Card’ means a card issued to any citizen who is below the poverty line;
- ‘Fee’ means amount payable by the applicant for obtaining any information under the provisions of Sub-section (1) of Section - 6 and Sub-sections (1) and (5) of Section - 7 excluding the cost of providing information;
- ‘Form’ means the specimen of forms appended to these Rules;
- ‘Identity’ means an evidence to show the citizenship like an electoral photo identity card, a passport, or any other document which can satisfy the authority about the citizenship of the person;
- ‘Schedule’ means a schedule appended to these Rules;
3. Procedure to obtain information:
- A citizen desirous of any relevant information from NAFSCOB may apply for such information in ‘Form – A’ to the CPIO, with the required fee either in the form of Demand Draft drawn in favour of ‘National Federation of State Co-operative Banks’ payable at ‘Mumbai’ or in cash. There is no fee for persons listed below poverty line which will have to be authenticated by producing the ‘BPL Card’;
- A citizen desirous of obtaining information from NAFSCOB through electronic means has to submit evidence regarding deposit of prescribed application fee;
- The CPIO shall furnish the acknowledgement to each of the applicant after being satisfied with the identity of the applicant and intimate such acknowledgement in ‘Form – B’ as soon as possible mentioning the cost for providing such information which is required to be paid by the applicant, as mentioned in the Schedule;
- The applicant has to deposit the said amount within a period of fifteen days from the date of receipt of such information, failing which the application stands rejected;
4. Information regarding rejection of application:
- Where an application is rejected under Section – 7(1) the CPIO shall intimate the applicant the reasons for such rejection in ‘Form – C’;
- Wherever information applied for is available in electronic means, the CPIO shall advise the applicant in ‘Form – C’ to obtain such information from the appropriate electronic means such as Website;
5. Memorandum of Appeal:
- An applicant for information may prefer an appeal under Section 19(1) and such appeal shall be filed in ‘Form – D’ to the Appellate Officer to hear such appeal;
- The memorandum of appeal shall be accompanied by such fee as specified for the first appeal;
- An applicant aggrieved by the decision under Section 19(1), may prefer a second appeal to the ‘Central Information Commission’ and such appeal shall be filed in ‘Form – E’ along with the fee as prescribed in the schedule for the second appeal. No fee shall be payable by persons below BPL and holding necessary proof of the same;
- Every order of the Appellate Officer shall be communicated to the concerned appellant, and to the Central Public Information Officer where such appeal is from the order of the Central Public Information Officer and to the first Appellate Authority by the Central Information Commission, in case it is a second appeal;
6. Maintenance of Register:
- The CPIO shall maintain a Register as detailed in ‘Form – F’ for recording the details of applications received as well as the information supplied by him and keep the head of the organization informed after furnishing any information and it shall be the duty of the head of the organization to ensure required assistance, if any, as would be sought by the CPIO to facilitate providing information;
- The CPIO shall maintain a Cash Register as detailed in ‘Form – G’ for recording the details of money received by him relating to providing information and deposit the said money in a separate head of account with the office of NAFSCOB.
